1. Wedding Date & Description. 7.5 Hour(s) total shoot time for the Wedding day of 12.30.23 (Ceremony, Reception & Travel) Venue Location @ Sisterdale Dance Hall 1210 Sisterdale Rd, Boerne, TX 78006, (Start times and special events see section 3.6 of Terms and Conditions) 

2. Payment. The Parties agree to the following Payment and Payment Terms:

Total Fee for Services: $2900

Non-Refundable Deposit Due Upon Execution of Agreement: $1450 (Deposit secures date and contract)

Balance Due 14 Days Prior to Event: $1450 (Balance can be broken up in payments if needed)

3 . Terms and Conditions.

  1. The Client agrees to provide a meal for the Photographer(s) if the Photographer’s attendance is required for greater than five (5) hours. (No table/seat is required, Photographer(s) will be allowed two breaks (at a time where no events are taking place) 1 to eat and another for personal time exceeding no more than 20 mins total)

  2. The Client agrees to give/have someone give the Photographer(s) sufficient warning of key events at the wedding to give the Photographer(s) time to prepare (i.e., bouquet toss, cake cutting, speeches, etc.)

  3. The Photographer(s) will endeavor to get photographs of as many guests as possible, which may be limited by guests’ cooperation in having their photo taken. 

  4. The Client agrees that the Photographer(s) shall be given precedence in taking photographs over guests with cell phone cameras and other devices. The Photographer(s) cannot be held responsible for lack of photographs or poor quality of photographs if guests are interfering with the Photographer’s work.

  5. The Client acknowledges the Photographer(s) may be limited in scope by rules of the location of the ceremony and/or reception. (i.e., flash photography may not be allowed within a Church).

  6. The Client agrees to give The photographer(s) an itinerary of their Wedding Ceremony event with start times, locations, etc. No later than 1-2 weeks prior to their wedding date. (Photographer(s) will arrive at 3:00 pm and the end time will be 10:30 pm, Additional time will be $300 per hour if needed by the client)

  7. The Client is responsible for choosing the location (within the San Antonio area) of their Bridal/Boudoir Session. Photographer(s) May suggest locations for the client upon request for no additional fee. (there are No Pre-bridals or engagement sessions for their package)

  8. The Client is given a choice of 2 photo selections from their Bridal/Boudoir session for their free 16x20 Portrait (Unframed) that The Photographer(s) will provide Prior to their wedding event. The Client is responsible for arranging pick-up or Delivery. (Client will not be having a pre-bridal or engagement session, the client will be selecting two portraits from their wedding day for print)

  9. The Client is responsible for any Parking, Entrance, or Photo permit fees required of the location(s).

  10. The Client is given a 15 Minute grace period to arrive at their scheduled Bridal/Boudoir session and Understands that The Photographer(s) May reschedule and Cancel the Session if The client is more than 15 minutes late, The client will be charged a $100  non-refundable fee per rescheduling and cancellation. (Client will not be having a pre-bridal or engagement session in their package)   

  11. The Client understands that there is no guaranteed amount of edited photos delivered to the client upon the finished Bridal/Boudoir/engagement, and Wedding event Photos. All photos will be delivered digitally on a USB Flash drive and a Private Google Drive Gallery, Photos can take up to 2 weeks to receive. (Client will not be having a pre-bridal or engagement session in their package) 

Copyright. The Photographer grants all rights of the photographs  to the Client. Client understands that Photographer(s) may use Images for Self Promotion (Social Media, Portfolio, Website Etc.). The Photographer will provide a Print and Release form for The client upon request.

Cancellation.

  1. By Client. The Client may cancel this Agreement at any time prior to the event. Upon cancellation, the Client Understands that The initial Deposit is Non-Refundable, but Additional payments made and monies received are also non-refundable but Transferable to any photography services the photographer provides. 

  2. By Photographer. The Photographer may cancel this Agreement at any time prior to the event. If the Photographer cancels, the Photographer must provide a suitable, replacement photographer, subject to the Client’s approval, which shall be obtained in writing. In the alternative, the Photographer shall refund all monies previously paid by the Client, including the non-refundable deposit. In the event the Photographer finds a suitable replacement photographer, the Photographer shall forward all monies already paid by the Client to the replacement photographer.

  1. Dispute Resolution and Legal Fees. In the event of a dispute arising out of this Contract that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful Party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.

  2. Severability. In the event, any provision of this Contract is deemed invalid or unenforceable, in whole or in part, that part shall be severed from the remainder of the Contract and all other provisions should continue in full force and effect as valid and enforceable. 

  3. Legal and Binding Contract. This Contract is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding both in the United States and throughout Europe. The Parties each represent that they have the authority to enter into this Contract.

  4. Governing Law and Jurisdiction. The Parties agree that this Contract shall be governed by the State and/or Country in which the wedding will be held. 

Entire Agreement. The Parties acknowledge and agree that this Contract represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both Parties.
